Former Minister of Security Public, Jose Raul Mulino, deemed as a disastrous precedent for the country the ruling of June 14 that annuls the decision of the Fifth Court, which ordered the nullification of the process for the purchase of radars.
Faced with the decision of the second Higher Court of Justice, which denies a nullity action in favor of the former Minister, he explained that he does not feel surprised, because they had already warned him that there would be an adverse resolution.
"The reason why it was changed was that it would create a precedent where they would have to close a lot of cases for the same abuses; but year 2019 is close, so we can begin to straighten the country", said Mr. Mulino.
He regretted that the proceedings by the judge who ordered his release is an administrative failure that ends up violating his fundamental rights.
"I cautioned that my process had been discontinued, and with the aim of clarifying I chose this route, because certainly it cannot be true that I be punished for defending my rights and now it turns out that the proceedings by the Prosecutor is validated because this was out of term," he explained.
He said that in the light of this situation, next week he will file a protection of Constitutional guarantees along with his defense team.
Mr. Mulino warned that his case would create a precedent, for the fact that every citizen may become vulnerable to being judged out the term and demand a second extension, as judge have contradicted s themselves by pointing out that defending yourself invalidates what has been acted.
The former government official said that everything would be a subject of political persecution, since there is a political motivation that may ultimately affect the Ministers that today signed contracts backed by the Cabinet, just as in the case of the contract with Finmeccanica.
He stressed that it is a message from the Government, with judges and prosecutors who are exceeding their functions.
"I know that somehow they aim to encroach my aspirations (political), but I will fight and time will tell", said.
Mr. Mulino said that the Government has two years chasing after him, using a newspaper and a television station.
"Here any newspaper receives come pieces of information, publishes it three times, and the following week we have a person being summoned to declare, but only those who are members of Cambio Democrático (CD)," he sustained.
Mr. Mulino said that Panamanians will return to better days and Cambio Democrático should remain in the opposition.
"I will try to take the lead when it should correspond through democratic mechanisms that would apply and we will try to get there," he said.
On the same matter, the defense team of the former Minister have said that they will attend the plenum of the Supreme Court of Justice (CSJ) to file a protection of Constitutional guarantees aimed at clarifying that the precautionary measure of country prison for Mulino is maintained.
